Terms of Service

These Terms of Service are an agreement between you and Pinners Haven, Inc. (“Pinners Haven,” “we,” “us,” or “our”) governing your use of the website at pinnershaven.com, the Pinners Haven application, and related services (together, the “Services”). By creating an account or using the Services, you agree to these terms and to our Privacy Policy.

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these terms.

You are responsible for the accuracy of your account information, for keeping your login credentials confidential, and for all activity that happens under your account. Notify us promptly at support@pinnershaven.com if you suspect unauthorized use. We may suspend or disable your account if you violate these terms or use the Services in a way that risks harm to Pinners Haven, other users, or connected platforms.

You may only connect Pinterest accounts that you own or are authorized to manage. You are responsible for the content you create, schedule, and publish through the Services, and for complying with Pinterest’s terms and policies for every connected account.

Pinners Haven acts at your direction to publish and analyze content on your behalf. We do not control Pinterest and are not responsible for its decisions, including rate limits, content review, or account actions it takes against a connected account.

Paid plans are billed in advance at the prices and intervals shown at signup. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel. Free trials convert to paid plans unless you cancel before the trial ends.

You can change or cancel your plan at any time from your account settings. Upgrades take effect immediately and are prorated; when you cancel, you keep access through the end of the period you have already paid for. Fees already paid are non-refundable except where a refund is required by law. We may change prices with advance notice, and you are responsible for any applicable taxes.

You agree not to use the Services to publish spam, deceptive, or misleading content; to infringe intellectual property or other rights; to harass, abuse, or harm others; to publish unlawful content; or to violate Pinterest’s policies or any applicable law.

You also agree not to reverse engineer, scrape, or attempt to gain unauthorized access to the Services; circumvent usage limits or security measures; resell or sublicense the Services without our permission; use the Services to build a competing product; or introduce malware or otherwise interfere with the Services. We may suspend accounts that do.

The Services, including the software, models, design, and Pinners Haven branding, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose while your account is in good standing. We reserve all rights not expressly granted.

You retain ownership of the content you create or upload. You grant us a limited, worldwide, royalty-free license to host, store, process, generate, and publish that content solely to operate the Services for you and, where you have enabled it, to publish on your behalf to connected platforms. This license lasts only as long as needed to provide the Services and ends when you delete the content or close your account, except for copies retained in routine backups or as required by law.

Content the Services generate for you, such as AI-assisted titles, descriptions, and images, is provided for your use. You are responsible for reviewing generated content before publishing it, and we do not guarantee that generated content is unique or free of third-party rights.

The Services integrate third parties, including Pinterest, AI providers, and payment processors. Your use of those integrations is subject to the third party’s own terms. If you supply your own AI provider API key, you are responsible for that provider’s terms and for any usage costs it charges you.

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if continuing to provide the Services to you would create risk or liability. On termination, your right to use the Services ends; sections that by their nature should survive — such as ownership, disclaimers, limitation of liability, and indemnification — will survive.

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure, and we do not guarantee any specific results, reach, or rankings on Pinterest or any other platform, or the behavior of those platforms.

To the maximum extent permitted by law, Pinners Haven and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold Pinners Haven harmless from claims, damages, and expenses, including reasonable legal fees, arising out of your content, your use of the Services, or your violation of these terms or of any third party’s rights.

These terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-laws rules. Pinners Haven, Inc. is incorporated in the State of Delaware. Any dispute arising out of or relating to these terms or the Services will be resolved exclusively in the state or federal courts located in the State of Delaware, and you and Pinners Haven consent to the jurisdiction of those courts. Nothing in this section limits either party’s ability to seek injunctive relief for misuse of intellectual property.

We may update these terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you. Your continued use of the Services after an update means you accept the revised terms.
